Terms of Service

1. Agreement to Terms

By accessing or using HopIn.it's mobile applications, website, or any of our services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not access or use our Services.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

2. Use of Services

2.1 Eligibility

You must be at least 13 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Services.

2.2 Account Responsibilities

If any of our Services require you to create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Services
  • Interfere with or disrupt the Services or servers
  • Transmit any malware, viruses, or harmful code
  • Use the Services to infringe on the rights of others
  • Reverse engineer, decompile, or disassemble any part of our apps
  • Use automated systems or software to extract data from our Services

3. Intellectual Property

Our Services and all associated content, features, and functionality—including but not limited to text, graphics, logos, icons, images, audio, video, software, and code—are owned by HopIn.it and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

  • Modify or copy our materials
  • Use our materials for any commercial purpose
  • Remove any copyright or proprietary notations
  • Transfer the materials to another person or "mirror" the materials on any other server

4. User Content

Some of our Services may allow you to submit, upload, or input content ("User Content"). You retain ownership of your User Content, but by submitting it, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of operating and improving our Services.

You are solely responsible for your User Content and represent that you have all necessary rights to submit it. You agree not to submit content that is illegal, offensive, defamatory, or infringes on third-party rights.

5. In-App Purchases and Subscriptions

Some of our apps offer in-app purchases or subscriptions. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions. We do not store or have access to your payment information.

Subscription renewals and cancellations are managed through your Apple ID settings. Refund requests must be submitted directly to Apple. Please review the specific pricing and terms for each in-app purchase before making a purchase.

6. Third-Party Services

Our Services may integrate with or contain links to third-party services, including AI services (such as OpenAI's ChatGPT), analytics providers, and other external platforms. These third-party services are governed by their own terms of service and privacy policies.

We are not responsible for the content, accuracy, or practices of any third-party services. Your use of third-party services is at your own risk.

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information provided through our Services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOPIN.IT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

In no event shall our total liability exceed the amount you paid us, if any, for accessing our Services during the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless HopIn.it and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
